Welcome to using the Hexagon Dinosaur Cloud Service (hereinafter referred to as “the Service”) provided by the Shanghai Institute of Technology Minecraft Club (hereinafter referred to as “the Club”). Before using the Service, please read and fully understand these Terms of Service (hereinafter referred to as “the Terms”). These Terms clarify the rights and obligations between you and the Club regarding the use of the Service.
Keywords in these Terms are for ease of understanding only and do not affect the meaning or interpretation of the Terms. Please read all contents of the Terms carefully, especially the sections concerning limitation of liability, applicable law, and dispute resolution. If you have any questions, please consult the relevant responsible personnel of the Club promptly.
1. Agreement Parties and Scope of Application
These Terms apply to your use of the Hexagon Dinosaur Cloud-related services provided by the Club. You acknowledge that using the Service signifies your acceptance of all contents of these Terms.
2. Service Content
2.1. The Service includes, but is not limited to, cloud-based server hosting, management, and related technical support for Minecraft, operated and maintained by the Club.
3. Service Fees
3.1. The Service is currently free of charge for teachers, students, and club members of our university. If there are any future plans for charging fees, the Club will notify users in advance via announcement. At that time, you may choose to continue using the Service and accept the fee-based terms or discontinue using the Service.
3.2. If fees are implemented and you refuse to pay, the Club reserves the right to suspend or terminate the Service provided to you and may delete related data.
4. User Rights and Obligations
4.1. You have the right to reasonably use the Service in accordance with these Terms and relevant platform instructions.
4.2. You shall properly safeguard your account information and password to ensure data security. Any losses resulting from improper safekeeping shall be borne by you.
4.3. You must comply with national laws and regulations, use the service content legally, and shall not upload illegal or non-compliant information.
4.4. You shall back up important data independently to ensure data security.
4.5. You shall not use the Service for any illegal purposes or activities that violate export control laws.
4.6. You shall cooperate with the Club in maintaining network security and legally preserve access records.
5. Club Rights and Obligations
5.1. The Club will provide stable and secure services as stipulated in these Terms.
5.2. Provide necessary technical support and fault handling services.
5.3. The Club is responsible for infrastructure and platform maintenance, while you are responsible for application and content management.
5.4. The Club does not guarantee that the Service will be completely error-free. You should understand the potential uncontrollable factors in the network environment.
5.5. The Club may provide account authorization management. Authorized operations will be deemed as actions performed by you.
6. User Data
6.1. User data belongs to the user. The Club protects data security in accordance with the law.
6.2. Without legal requirements or your authorization, the Club will not use or disclose user data arbitrarily.
6.3. After service termination, data will be retained for a specified period and deleted upon expiration.
6.4. Users should exercise caution when deleting data, as deleted data cannot be recovered.
7. Intellectual Property
7.1. All intellectual property rights involved in the Service belong to the Club or relevant rights holders.
7.2. Users shall ensure that uploaded and used content does not infringe upon third-party rights.
7.3. In case of intellectual property disputes, both parties shall cooperate in handling the matter, and the breaching party shall bear the responsibility.
8. Confidentiality Obligations
8.1. Both parties have a confidentiality obligation regarding confidential information learned during the service process.
8.2. Confidential information shall only be used for the purpose of the agreement and shall not be disclosed without authorization.
8.3. Exceptions apply as permitted by law or as otherwise agreed upon by both parties.
9. Service Termination and Modification
9.1. The Club reserves the right to terminate or suspend the Service under the following circumstances:
- Mutual agreement between both parties;
- Serious violation of the Terms by the user;
- Legal, regulatory, or network security requirements;
- Operational adjustments by the Club.
9.2. In case of service modification or cessation, the Club will notify users via announcement in advance.
10. Liability for Breach
10.1. If a user violates these Terms or relevant regulations, the Club may take measures such as restricting, suspending, or terminating the Service and pursue legal liability accordingly.
10.2. If a user causes losses to the Club due to illegal acts or breach of contract, the user shall compensate for such losses.
10.3. The Club shall not be liable for brief interruptions caused by network issues or maintenance processes.
10.4. Users understand and accept the risks inherent in network services.
11. Notices
11.1. Users shall ensure that contact information is accurate, valid, and updated promptly.
11.2. Notices delivered by the Club via email, internal messages, announcements, etc., shall be deemed effectively served.
12. Force Majeure
Neither party shall be liable for service interruptions or impacts caused by force majeure.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the People's Republic of China. In case of disputes, both parties shall prioritize negotiation for resolution. If negotiation fails, either party may file a lawsuit with the court located at the university's location.
14. Supplementary Provisions
14.1. These Terms, along with related appendices and service descriptions, constitute the entire agreement.
14.2. Updates to the Terms will be announced in advance. Continued use of the Service signifies acceptance of the updated contents.
14.3. The Club reserves the right to transfer the rights and obligations under these Terms and will notify users in advance.
